Argues tough sentence needed for cop-shooter

Convicted cop-shooter Daniell Ian Anderson should be sentenced to 20 years in prison, a judge was told yesterday.
Anderson, "a self-described drug abuser" who made his living selling marijuana from home, should not be eligible for parole before serving 10 years of his sentence, Crown attorney Brian Bell told Justice Doug Abra.
Anderson was convicted last December of one count each of attempted murder, discharging a firearm with intent to wound, and possession of a dangerous weapon.
Anderson shot and wounded two police officers in December 2006 during a surprise drug raid at the Jubilee Avenue home he shared with his parents.
Bell said society has a "covenant" or agreement with police to protect them from harm and death, an agreement that requires the imposition of harsh prison penalties for those who break it.
"Police are the first line of defence for protecting society," he said.
Defence lawyer Roberta Campbell argued Anderson should be sentenced to seven years in prison.
Anderson testified at trial he believed he was the victim of a home invasion when he barricaded himself in a bathroom and fired a shotgun through the wall, seriously wounding constables Don Murray and Curtis Penner.
A third officer, Const. Jeremy Cull, was wounded after a shot from Penner's gun pierced a wall and struck him in the leg.
Anderson suffered a gunshot wound to his elbow and hand.
Campbell rejected the Crown's claim Anderson "ambushed" police. Campbell said Anderson voluntarily dropped his shotgun when he realized he had been shooting at police officers.
The shootings, Campbell said, were "an over-reaction to what he perceived to be a break-in to his house." Anderson, speaking in a flat monotone, offered a brief apology to the police officers he shot and their families.
"I wish I could go back to that night and take everything back, but that is not possible," he said.
Abra will sentence Anderson July 21.
Earlier this year, Abra rejected a defence motion to stay the charges on the grounds police used excessive force in arresting Anderson.
Anderson said police officers repeatedly punched him in the head as they dragged him to a cruiser car. Officers testified they hit Anderson because he was resisting arrest.
Abra ruled police used no more force than necessary in arresting Anderson.

Queen's Bench Justice Doug Abra has a very big decision to make over the weekend.
Abra found cop-shooter Daniell Ian Anderson guilty of attempted murder last year and now has to sentence the man who nearly killed two police officers in the line of duty.
His ruling is expected Tuesday.
Anderson shot at the cops during a 2006 drug raid on Jubilee Avenue, showing not only a complete disregard for human life, but a dangerous indifference to the men and women in uniform who stand between us and the scumbags of this world.
Surge in attacks
This is no ordinary attempted murder case.
Winnipeg police have been under increasing attack by criminals. We've seen repeated stories of punks ramming cars into police cruisers and into police officers.
There has been a surge in attacks against police officers, including punks lunging at cops with knives and screwdrivers.
Apparently, attacking cops is a badge of honour for some. And we have to stop it.
Anderson, in a cowardly attempt to fend off police who were doing their job by conducting a drug raid, opened fire on them, hitting one in the stomach.
When Anderson did that, he not only shot at police officers, he attacked the line of defence we have between order and disorder.
He attacked society as a whole.
This is a watershed case. We will see how our justice system responds to this growing and dangerous trend of criminals attacking cops.
This is an extremely important case because it will define how we as a society respond to this threat.
Crown Attorney Brian Bell has asked for 20 years in prison for Anderson, with no eligibility for parole for 10 years.
That would be a fit sentence. It would not only satisfy the sentencing principals of general and specific deterrence and the requirement that sentences be proportionate to the gravity of the crime.
It would provide a very important form of denunciation.
It's imperative that our justice system stands up and denounces these attacks on police and denounces them loudly.
This case will set the bar for how much tolerance we are prepared to give to people who try to kill police officers.
We should give none. We should have no tolerance whatsoever for scumbags like Anderson who shoot at police.
Which means Justice Abra must place greater weight on the sentencing principles of deterrence and denunciation than on any other factor.
Stand idly by
Anderson's defence lawyer has proposed a prison term of seven years, which is a joke. Anything less than 15 years would put the administration of justice into disrepute.
It would tell society and police that we have some tolerance for the increasing attacks on police. It would say very loudly that we are prepared to stand idly by while criminals try to create anarchy in society.
Bell's 20-year sentencing recommendation is the right one. It would send a strong message to criminals that if they choose to attack police, we as a society -- through our courts -- will respond aggressively and mercilessly.
I hope Justice Abra understands the importance of this case.

Well the way that I see it this is what mostly is going to happen. On Monday when he goes for sentencing at the Law Courts he'll make sure the courtroom is packed with friend's and family, it's always good to have a crying Mother in the Courts. What Judge is going to throw the book at some "kid" while Mommy is sitting there. She'll be asked to give a statement and most likely how he was a honour student, never was in trouble, she can't understand what happened, and " please Mr. Judge, I can't live without him for 20 years". Not once taking in the fact that the officer shot in the stomach also has a Mom, was almost killed on that take down, has PTSD now, and a FAMILY of his own. His partner who was also injured in the shooting now has nightmares of that December night, has had a marriage break-up because of it, and has to under go counselling to releave the trauma inflicted by the " accused and now guilty's " one act of stupidity.
How can defence lawyers sleep at night, especially when they argued to have the case thrown for " excessive use of force " in taking this guy down?? THERE was no excessive use of force in my eyes here folks, when shots are fired, officers down and bleeding, it's a game of " no holds barred" now. It comes down to a me or him scenario. I kind of enjoy life, I would have punched him in the head numerously also. There was no EXCESSIVE force used!! It was NECCESSARY FORCE!! The asshole has a shot gun and is not afraid to use it!!
It should be interesting come Monday when sentencing occurs, I'll know about it first hand as I have a case before the Courts on Monday and I'll be there!! I'll let you know.......
